Kentucky – Statute §367.840

Vehicles Covered:

Vehicles primarily for use on highways, required to registered or licensed in-state prior to use. Excludes conversion vans, motor homes, motorcycles, mopeds, and farm machinery including tractors or vehicles with more than two axles.

Persons Covered:

Residents who buy or contract a new motor vehicle in-state.

Period Covered:

Whichever is first: 12,000 miles or 12 months from date of delivery.

Notice Requirement:

(a) Manufacturer – notify the buyer at the time the dispute arises of the arbitration system; (b) Consumer – in writing to the manufacturer.

Repair Requirements:

It is presumed that a reasonable number of attempts have been made if the same nonconformity has been subjected to three or more repairs, or the vehicle is out of service for a cumulative total of 30 or more calendar days.

Affirmative Defenses:

The nonconformity does not significantly impair the use, market value or safety of the vehicle, or is the result of abuse, neglect, or any unauthorized modification or alteration by the consumer; statute of limitations.

Replacement/Refund:

At the consumer's option, the manufacturer shall replace with a comparable vehicle, or refund the full purchase price les a reasonable allowance (defined).

Other Reimbursement:

Full purchase price, including amount paid, finance charges, sales charge, and all collateral charges, taxes, fees, and refund to the consumer: Reasonable attorney fees.

Other remedies:

There is no limit on other consumer remedies.

Arbitration:

For remedies under this section, a consumer must use the informal dispute procedure established by the manufacturer as long as it conforms to 16 C.F.R. 703.
