Vehicles Covered:
|
Passenger automobiles, including pickups and
vans, and motor and van portions of recreational equipment that are sold
or leased in state.
|

Persons Covered:
|
Purchasers or lessees for personal, family,
or household purposes for at least 40% of the time, transferees or any
other person entitled to enforce the warranty.
|

|
|
Period Covered:
|
Whichever is first: term of express warranty
or within two years from date of delivery.
|

|
|
Notice Requirement:
|
(a) Secretary of State notice to accompany title
of new car as specified; (b) Consumer – shall notify the manufacturer
by return receipt service.

|
|
Repair Requirements:
|
It is presumed that a reasonable number of attempts
have been made if the same nonconformity has been subjected to four or
more repairs, or the vehicle is out of service for a cumulative total
of 30 or more business days; or braking or steering system failure that
is likely to cause death or serious injury is subjected to one or more
repairs.

Affirmative Defenses:
|
The nonconformity does not significantly impair
the use, market value of the vehicle or is the result of abuse, neglect,
or unauthorized modifications or alterations.

|
Replacement/Refund:
|
At the consumer's option, the manufacturer shall
replace with a comparable vehicle, or refund the full purchase price les
a reasonable allowance (defined).

|
|
Other Reimbursement:
|
Costs of options or modifications, fees, costs
of towing and rental expenses, and refunds to the consumer and lienholder.
|

|
|
Other remedies:
|
A consumer may bring a civil action to redress
a violation of this section, and can recover costs and disbursements,
including reasonable attorney fees.
|

|
|
Arbitration:
|
For remedies under this section, a consumer
must use the informal dispute procedure established by the manufacturer
provided that it complies with 16 C.F.R. 703, unless the manufacturer
allows the consumer to commence an action.

|
Resale of Lemon:
|
Full disclosure required; 12 month/12,000 mile
warranty. A) No sale of a vehicle with a serious defect pursuant to lemon
law returned in this or any other state.
