Vehicles Covered:
|
New vehicles not propelled by muscular power. Includes lease-purchases, demonstrators, and chassis portion of recreational vehicles. Excludes commercial vehicles, off-road vehicles, mopeds, motorcycles, and other parts of recreational vehicles.

Persons Covered:
|
Purchaser, transferee during express warranty term, or any person entitled to enforce warranty.

Use Covered:
|
Vehicle primarily used for personal, family, or household purposes.

|
Defects Covered:
|
Defect impairs use, market value, or safety of vehicle to consumer.

Period Covered:
|
Warranty term or one year, whichever is first.

|
Notice Requirement:
|
Written notice to manufacturer of need for repair. Manufacturer entitled to final repair attempt after notice.

"Reasonable" Repair Guidelines:
|
During period covered, either at least four repairs to same defect or at least 30 working days out of service for repairs. Creates presumption.

|
Affirmative Defenses:
|
Defect does not substantially impair use, market value, or safety of vehicle, or results from abuse, neglect, or unauthorized modifications or alterations; claim not filed in good faith. Statute of limitations: 18 months from delivery or six months from end of warranty term, whichever is first, or 90 days from final action of informal settlement panel.

|
Replacement or refund, at manufacturer's option.

Refund Details:
|
Full purchase price, including collateral charges such as sales tax, title fees, license and registration fees. Deduction for use.

Other Remedies:

Mandatory costs, expenses, and attorney's fees to consumer. Mandatory costs and reasonable attorney's fees to manufacturer if claim filed in bad faith or consumer's recovery not at least 10% greater than manufacturer's offer. Commercial Code does not apply to new motor vehicle sales. No other limit on other consumer remedies.
