Vehicles Covered:
|
Passenger vehicles or motorcycles as defined
in NJ statutes, purchased, leased or registered in state. Excludes living
facilities of motor homes.

Persons Covered:
|
Purchasers, lessees, transferees during express
warranty period or any person entitled to enforce the warranty.
|

|
|
Period Covered:
|
Whichever is first: 18,000 miles or within two
years from date of delivery Consumer must pay for repairs made after 12,000
miles or one year after delivery unless covered by manufacturer's warranty.

|
|
Notice Requirement:
|
(a) Manufacturer – specific written notice upon
sale or lease and notice of applicability of lemon law statement of repair
each time vehicle serviced within lemon law period; (b) Consumer – written
notice by certified mail and return receipt, to the manufacturer by or
on behalf of the consumer; opportunity to cure within ten days of receipt
of notice.

Repair Requirements:
|
It is presumed that a reasonable number of attempts
have been made if the same nonconformity has been subjected to three or
more repairs, or the vehicle is out of service for a cumulative total
of 30 or more business days within the shorter of two years or 18,000
miles.

Affirmative Defenses:
|
The nonconformity does not significantly impair
the use, market value or safety of the vehicle, or is the result of abuse,
neglect, or any unauthorized modifications or alterations.

|
Replacement/Refund:
|
The manufacturer shall replace with a new comparable
vehicle, or refund the full purchase price less a reasonable allowance
(defined). Consumer may reject replacement.

|
|
Other Reimbursement:
|
Taxes, fees, and charges; refund to consumer
and lien holder.
|
| |
|
|
Other remedies:
|
There is no limit on other consumer remedies:
Attorney fees, fees for expert witnesses and court costs recoverable.

|
Arbitration:
|
There is no requirement to arbitrate, but there
is a right to an administrative hearing, or an informal dispute settlement
procedure.
|

|
|
Dealer Liability:
|
None, except for express warranties made by
the dealer apart from the manufacturer.
|

Resale of Lemon:
|
|
